RSS, just like every other online item with infinite usages cannot be dropped. Sorry.
Only Eyes of Death and Cracked Red Eye Orbs can be dropped.

I don't know your circumstances, but you should try to get a refund for your disc, or buy a new copy of the game, even if used.
Not only it will solve your problems, but you're risking damaging you hardware by putting a damaged disc in it.

im definatley going to get anew copy lol i have unfinished characters and its a pain in the ***
my good characters are trapped in unload able spots too xDD
and you serious it'll damage the data? or the system?

That depends on the way the disc is damaged.
If the damage is physical, like a crack, or a deep scratch, there is a possibility of it damaging the laser lens. It's an extremely slim chance though, no matter the HW you're using.
Anyway, if the damage makes the system to freeze, or suddenly quit game, restart, or anything like that, it can corrupt your Save Data. Unless you have a backup, it would mean losing everything.
