I believe you need to kill Nito before patches will move to the firelink shrine.

It depends if he is still down at the ToS after you killed Nito.
You need to kill Nito in order for him to move to firelink shrine. If he still hasn't moved from the Tomb though you might need to kill him at the Tomb, after you've done that he will spawn at Firelink Shrine.

Jolly Patches will go to Firelink after you've killed Nito. HE MAY go before but i don't know why AND IT'S RARE.

He seems to be a bit glitchy. I usually get him to come to firelink after nito as well though. But honestly, its been awhile. After a few playthroughs he has nothing i need. So patches just gets killed and i never bother to look for him after that.
If your in need of a specific item he sells, i'd check the trade/player help you may get quicker results. Msg me if you want i won't make a character for you but if i have one in range i can see what happens.q
